which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to prohibit Federal Medicaid funding for gender transition procedures for minors.</official-title></form><legis-body id="H92B27F055F874DE38C654A892FB06828"><section id="HE23F8EC337C247E08FD31F75FEDF898E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Do No Harm in Medicaid Act</short-title></quote>.</text></section><section id="HEE74DA0011964CBB85F7B72A37A53BA8"><enum>2.</enum><header>Prohibiting federal medicaid funding for gender transition for minors</header><subsection id="H2A980CFF2A784F4EBE95E8B9AEA83988"><enum>(a)</enum><header>In general</header><text>Section 1903(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended—</text><paragraph id="HF403A0072E2B470995F3355796CC20C6"><enum>(1)</enum><text>in paragraph (26), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph id="H85D48DD50A0246E2A8DE3704BB37F4DB"><enum>(2)</enum><text>in paragraph (27), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H175AD474634041DABCF8C723ED4A9E3E"><enum>(3)</enum><text>by inserting after paragraph (27) the following new paragraph: <quote>(28) with respect to any amount expended for specified gender procedures under section 1905(kk) to an individual under 18 years of age enrolled in a State plan (or waiver of such plan), including any amounts expended for the administration of a State program that furnishes specified procedures and drugs to individuals under 18 years of age.</quote>.</text></paragraph><paragraph id="HB017AB7AFB1B4FEC8C5B5822476035C8"><enum>(4)</enum><text>in the flush left matter at the end, by striking <quote>and (18),</quote> and inserting <quote>(18), and (28)</quote>.</text></paragraph></subsection><subsection id="H14C205E714064242A84C8C307788588B"><enum>(b)</enum><header>Prohibiting federal medicaid funding for gender transitions for minors</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H86591E65ABE840F5B3055713910C3BF6" style="OLC"><subparagraph id="HEE72CF1F50C54C3182039A46864ECB1C"><enum>(KK)</enum><header>Prohibiting federal medicaid funding for gender transitions for minors</header></subparagraph><subparagraph id="HC5AF881044E4453C9C02A502D87E0160"><enum>(A)</enum><text>For purposes of section 1903(i)(28), except as provided in subparagraph (B), the term <quote>specified gender transition procedures</quote> means, with respect to an individual, any of the following when performed for the purpose of intentionally changing the body of such individual (including by disrupting the body’s development, inhibiting its natural functions, or modifying its appearance) to no longer correspond to the individual’s sex:</text><clause id="H59108258881944E2A493602EA3169DC3"><enum>(i)</enum><text>Performing any surgery, including—</text><subclause id="H4753F31010C94C6BB1926D9479A11D15"><enum>(I)</enum><text>castration;</text></subclause><subclause id="H851DA9EB3C004F7B9F0DB3E40D856E26"><enum>(II)</enum><text>sterilization;</text></subclause><subclause id="H6439F55F26764EBE9F965C99E0A7AF32"><enum>(III)</enum><text>orchiectomy;</text></subclause><subclause id="H65CCE6ACB8374CDDB101D03BB2E7D23C"><enum>(IV)</enum><text>scrotoplasty;</text></subclause><subclause id="HB6C484B3F4A34B04A83996B012F256C9"><enum>(V)</enum><text>vasectomy;</text></subclause><subclause id="H9937CD0919E74364903A5DAA0147255E"><enum>(VI)</enum><text>tubal ligation;</text></subclause><subclause id="HE26D1E4A3C2A44E3BF5357475504D7E8"><enum>(VII)</enum><text>hysterectomy;</text></subclause><subclause id="H083022865C264D00A5D55CDEF0B4251C"><enum>(VIII)</enum><text>oophorectomy;</text></subclause><subclause id="H5C82A7CE618641D88979B57E00055EE6"><enum>(IX)</enum><text>ovariectomy;</text></subclause><subclause id="HEEC13A47FBF04323A89F56BB63D7014C"><enum>(X)</enum><text>metoidioplasty;</text></subclause><subclause id="HCD897733999D4FC598188A827D7CF93C"><enum>(XI)</enum><text>clitoroplasty;</text></subclause><subclause id="H22BC8F0E2CCF49A6A14EB0764729FFAA"><enum>(XII)</enum><text>reconstruction of the fixed part of the urethra with or without a metoidioplasty or a phalloplasty;</text></subclause><subclause id="HAE3F8DB6DC784EA895EA03EEE26645B5"><enum>(XIII)</enum><text>penectomy;</text></subclause><subclause id="H5C7AD9D535054F0C8ADC3E341F68F43C"><enum>(XIV)</enum><text>phalloplasty;</text></subclause><subclause id="H8299333F1C574BBDA30BE291875914DC"><enum>(XV)</enum><text>vaginoplasty;</text></subclause><subclause id="H3B88BFA2C2EF4F4585C983783BE8487F"><enum>(XVI)</enum><text>vaginectomy;</text></subclause><subclause id="H0B26071228964CDEB00CE1C5DC8D791F"><enum>(XVII)</enum><text>vulvoplasty;</text></subclause><subclause id="H473DA109B8B348D58ED6B0C42DCC2D89"><enum>(XVIII)</enum><text>reduction thyrochondroplasty;</text></subclause><subclause id="H62AC1CB31F9A455783C6A7CA1FD244B1"><enum>(XIX)</enum><text>chondrolaryngoplasty;</text></subclause><subclause id="H0021451C61894F3291DABEDAFF7B5316"><enum>(XX)</enum><text>mastectomy; and</text></subclause><subclause id="HA70F29DDD6294FA5B5B5B310DD10AB41"><enum>(XXI)</enum><text>any plastic, cosmetic, or aesthetic surgery that feminizes or masculinizes the facial or other physiological features of an individual.</text></subclause></clause><clause id="H6D73B33D5B5145BC9E15EA5E616866B4"><enum>(ii)</enum><text>Any placement of chest implants to create feminine breasts or any placement of erection or testicular prosetheses.</text></clause><clause id="HDD56CDB8354542C2BA4C3E3A3278437B"><enum>(iii)</enum><text>Any placement of fat or artificial implants in the gluteal region.</text></clause><clause id="HF1F748A49217434AA1A14C99C96CCAD9"><enum>(iv)</enum><text>Administering, supplying, prescribing, dispensing, distributing, or otherwise conveying to an individual medications, including—</text><subclause id="H37313BCEA7A9495FB5CB6D26E877829D"><enum>(I)</enum><text>gonadotropin-releasing hormone (GnRH) analogues or other puberty-blocking drugs to stop or delay normal puberty; and</text></subclause><subclause id="H8D6DB784AF0A4FE586F32FCBA7AAB445"><enum>(II)</enum><text>testosterone, estrogen, progesterone or other androgens to an individual at doses that are supraphysiologic, greater or more potent than would normally be produced endogenously in a healthy individual of the same age and sex.</text></subclause></clause></subparagraph><subparagraph id="H66EA356113B146C2B1094E581CAF4653"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to the following when furnished to an individual by a health care provider with the consent of such individual’s parent or legal guardian:</text><clause id="H023ED898F04C4EC8A312104F5D70F6F9"><enum>(i)</enum><text>Puberty suppression or blocking prescription drugs for the purpose of normalizing puberty for an individual experiencing precocious puberty.</text></clause><clause id="H42B7773FB11C4E93BEF66E3C6701A6FA"><enum>(ii)</enum><text>Appropriate and medically necessary procedures or treatments to correct for—</text><subclause id="HA0BC8ECE479A4CF18F31B1ACCE567BC9"><enum>(I)</enum><text>a medically verifiable genetic disorder of sex development, including—</text><item id="H4D1225A3C4DE49E4B11B0533E1B4DEDE"><enum>(aa)</enum><text>46,XX chromosomes with virilization;</text></item><item id="H6EF1764AA489406FB04B014820D0304C"><enum>(bb)</enum><text>46,XY chromosome with undervirilization; and</text></item><item id="HD0F9CFCFA0A743C4988CE263E2F39FB5"><enum>(cc)</enum><text>both ovarian and testicular tissue;</text></item></subclause><subclause id="HC305A117403948D6B89E7231BDE3D97E"><enum>(II)</enum><text>sex chromosome structure, sexsteroid hormone production, or sex hormone action, if determined to be abnormal for a healthy individual of the same sex and age by a physician through genetic or biochemical testing;</text></subclause><subclause id="HAB477C3D96924B1F94EC74C9A776A334"><enum>(III)</enum><text>infection, disease, injury, or disorder caused or exacerbated by a previous procedure described in subparagraph (A), or a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the individual in imminent danger of death or impairment of a major bodily function unless the procedure is performed, not including procedures performed for the alleviation of mental distress; or</text></subclause><subclause id="H647455009FF446DAA6CE8A7DC69F8D4E"><enum>(IV)</enum><text>procedures to restore or reconstruct the body of the individual in order to correspond to the individual’s sex after one or more previous procedures described in subparagraph (A), which may include the removal of a pseudo phallus or breast augmentation.</text></subclause></clause></subparagraph><subparagraph id="H6A273A271535403D8357B48D6E2D5E9C"><enum>(C)</enum><header>Sex</header><text>For purposes of subparagraph(A), the term <quote>sex</quote> means either male or female, as biologically determined and defined by clause (i) and clause (ii).</text><clause id="H676C06C203B74231958077A792761D59"><enum>(i)</enum><header>Female</header><text>The term <quote>female</quote> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization.</text></clause><clause id="H5EF15C88E37C4FBCA5F93B227D5F3A8C"><enum>(ii)</enum><header>Male</header><text>The term <quote>male</quote> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes sperm for fertilization.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
